Form 8962 repayment caps: use the correct tax year

Understand how excess advance premium tax credit repayment limits work and why a 2025 cap should not be reused for a 2026 return.

Direct answer
Repayment caps are tax-year specific. The final 2025 Form 8962 instructions cap repayment below 400% FPL, but there is no cap at 400% FPL or above. ACAIndex does not project a 2026 cap before final IRS instructions are available.

Why the coverage year matters

Advance credits are reconciled on the return for the same calendar year as the coverage. A 2026 Marketplace estimate is not a substitute for the final 2026 Form 8962 instructions. Inflation adjustments and legislation can change the applicable amount.

Reduce reconciliation surprises

Update the Marketplace when household income, family size, access to employer coverage, or tax-filing circumstances change. Keep Form 1095-A and verify its benchmark premium before completing Form 8962.
